Misleading advertisements on targeted coaching institutes: CCPA imposes penalty of Rs 64 lakh

Today, the Department of Consumer Affairs issued new guidelines to control misleading advertisements for coaching establishments. The new CCPA (Central Consumer Protection Authority) guidelines aim to tackle misleading practices by training institutes. The guidelines focus on transparency and truthfulness in advertising and require training centers to present accurate information to students and parents.

In 2023, the Union Public Service Commission (UPSC) is conducting examinations for 1,016 posts. However, many training institutes lied to nearly 3,000 people who passed their programs. To prevent such misleading claims, CCPA has introduced strict measures.

Key steps include
Clear disclosure of course details: Training institutes must provide clear information about the length of the course, the terms, and conditions for withdrawing the course, and any free interview programs offered.

Honest Advertising: Advertisements containing claims of success must be supported by real evidence. False contingencies such as limited seat promotions are now classified as unfair trade practices.

Use of success stories and images: If the institution uses images or data of successful individuals, written consent from those candidates is required.

Proper display of disclaimers: Disclaimers should be visible, with important information presented on the first slide of any promotional content.

Full information on facilities: Facilities must disclose the power, environment, and safety features of their facilities, as well as emergency evacuation plans. They must also ensure that all necessary permits from the local authorities are in place.

Addressing security issues
After incidents of students losing their lives due to inadequate safety measures, such as drowning or electrocution in training facilities, the CCPA enforces stricter safety regulations. Institutions must provide detailed safety information and comply with local regulations to ensure a safe learning environment.

Penalties for violations
To enforce these guidelines, the CCPA has imposed penalties.
Fine up to Rs 1 lakh for first violation.
Fine up to Rs 50 lakh for repeated or serious violations.
Cancellation of license for persistent non-compliance.

Handling consumer complaints
Institutions are now required to have an effective system for handling and resolving student and parent complaints.
