Defense attorneys for a young Mississippi killer want a new trial because he was ‘treated by horses,’ they heard.

Defense attorney Carly Gregg, 15, says her client deserves a new trial because she was previously treated for hearing voices using a horse.
In September, the judge Rankin County, Mississippifound Gregg, 15, guilty of all charges, and prosecutor Kathryn Newman said Gregg had shown “remorse.”
The teenager was charged murder and aggravated assault in the March 19 shooting that killed his mother, Ashley Smylie, 40, and injured his stepfather, Heath Smylie. He was also charged with tampering with evidence by hiding a security camera after the shooting.
On the first and second counts, Gregg was sentenced to life in prison. In the third count, you got 10 years.

Viral footage, shown at trial, showed the harrowing moments when the teenager opened fire on his mother.
Now, Gregg’s defense said the child’s father revealed that he was “put into horse therapy as a young child because of hearing loss.”
“This new information supports Dr. Clark’s diagnosis of unspecified schizophrenic disorder and may have led to a different result in the new trial,” the defense said. “With that, Carly is entitled to a new trial.”

The defense attorney said “undisputed evidence” of the circumstances leading up to Gregg’s actions should result in a conviction.
“The undisputed evidence in the case of Carly’s mental illness, loving relationship with her mother and stepfather, no criminal convictions, no previous violence, good school record, mother’s family support, community support, victim’s testimony that Carly was not in her right mind and did not recognize who she was at the time of the trial, and the State’s admission that there was no reason to commit these crimes does not support the verdict or sentence in this case,” the attorney wrote.

“Therefore, this issue requires a new trial, or else, a verdict is issued despite the verdict,” they said.

Judge Dewey Arthur disagreed with the decision, saying that no information was disclosed that required a new trial.

“This Court finds that there is nothing new and important [sic] was discovered that might have produced a different result at trial and, with reasonable diligence, this evidence could not have been immediately discovered,” Arthur wrote.
“The Court reviewed the statements and found that these statements probably would not have produced a different result during the trial,” he said.
