Danny Masterson Appeals For Rape After 30 Years In Prison
Danny Masterson He appealed the rape case after being sentenced to 30 years in prison.
Masterson Attorney, Cliff Gardnerassigned to a 246 page opening brief on Wednesday, December 18, saying that several mistakes were made that “violated” the player’s “rights to conflict and due process.”
Gardner also issued a statement saying “two significant errors in Danny Masterson’s case.”
In the first error, he said, “the case was riddled with erroneous judicial decisions that distorted the judge’s view of the evidence against him.” And in the second, the attorney said there was “a surprising amount of evidence that was never presented to the jury.”
Gardner said “the appeal represents only one part of Danny’s challenge to his convictions. Danny’s habeas attorney will be following up the opening brief with a Petition for Writ of Habeas Corpus documenting other procedural errors. Stay tuned as we work towards Danny’s full release.”
Four women said in March 2017 Masterson, 48, sexually assaulted them in the early 2000s. The fifth woman came forward in December 2017, saying that while she was dating the actor, he “raped her repeatedly”.
Masterson maintained his innocence and pleaded not guilty to three counts of rape in January 2021. His first trial began in the fall of 2022, ending in a trial. Masterson was tried again in the spring of 2023 when he was convicted of two counts of rape. In September 2023, he was given a sentence of 30 years in prison. He appealed two months later; it was rejected in January.
Before his conviction, Masterson was best known for his role as Steven Hyde in That ’70s Show from 1998 to 2006 and his role in Netflix’s The Ranch as Jameson “Rooster” Bennett from 2016 to 2018.
Masterson’s wife, Hi Phillipsfiled for divorce in September 2023 after 12 years of marriage. The following month, Us confirmed that Masterson had agreed to give Phillips, 44, full legal and physical custody of their daughter, Fianna, 10.
In December 2023, Masterson became he was admitted to the prison system and began his sentence at North Kern State Prison in Delano, California. He was later transferred to California Men’s Colonya minimum security prison in San Luis Obispo. Masterson will not be eligible for parole until July 2042, when he will be 66 years old.
